Terms of service
Semper Math is for families: a parent or guardian 18 or older holds the account, and every learner is 13 or older. Lesson time is $17.50 per half hour, and unused time is refundable within 30 days.
The agreement
These terms are an agreement between you and The Adelaide Group LLC (“we”, “us”), which runs Semper Math, this website, and the Semper Math tutoring app. By creating an account, buying lesson time, or using Semper Math, you agree to these terms and to our privacy policy. If you do not agree, please do not use Semper Math.
“You” means the parent or guardian who holds the account. “Learner” means a young person you add to your account.
Who can use Semper Math
- Accounts are for parents and legal guardians who are 18 or older and live in the United States.
- Each learner must be 13 or older. Learners under 13 may not use Semper Math at this time.
- You may add only learners you are the parent or legal guardian of, and you confirm each learner's age when you add them.
- During the beta, accounts are by invitation.
Your account
- You sign in with a one-time link sent to your email. Keep that email account secure, because anyone who can read it can sign in to Semper Math.
- You are responsible for activity on your account, including your learners' use of it.
- An account is for one family. Please do not share it outside your household.
- Tell us right away at support@sempermath.com if you think someone else has used your account.
Learners and supervision
You decide when and how your learners use Semper Math. We recommend a grown-up is nearby, especially for the first lessons. You agree to read our Pip and AI safety page and to explain to your learners that Pip is an AI, not a person.
Pricing and payment
- Live lesson time costs $17.50 for each 30 minutes, bought in advance in 30-minute blocks.
- Your family's first purchase includes 20 bonus minutes.
- Time is used by the minute while a live lesson is running.
- Purchased time is valid for 12 months from the date of purchase. Unused time expires after that.
- Prices are in US dollars. Taxes are added where they apply.
- Payments are processed by Stripe and appear on your statement as “JCIL.AI* SEMPERMATH”. You agree to Stripe's terms for the payment itself.
- We may change prices for future purchases. Time you have already bought keeps the price you paid.
Refunds
- Unused purchased time can be refunded within 30 days of purchase. Email billing@sempermath.com from the address on your account.
- Time that has already been used is not refundable.
- If a lesson fails because of a problem on our side, we restore the minutes it used.
- Bonus minutes have no cash value and are not refundable.
- Nothing in these terms limits any refund rights you have under the law.
Acceptable use
Please use Semper Math for learning math. You agree not to, and not to let anyone on your account:
- use Semper Math to harm, harass, or deceive anyone, or try to get Pip to produce harmful content;
- try to break, overload, probe, or get around the security or limits of the service;
- copy, scrape, resell, or build a competing service from Semper Math or its lessons;
- share your account outside your family, or add a learner who is not yours or who is under 13;
- use Semper Math in a way that breaks the law.
AI tutoring
- Pip is an AI, not a person.
- Math answers shown on the board are checked by code, but Pip's spoken explanations come from an AI model and can still contain mistakes.
- Semper Math supports teachers and parents. It does not replace them, and it is not a substitute for school, professional tutoring, testing, or any kind of medical, psychological, or safety advice.
Our content and your work
- Semper Math, Pip, our lessons, videos, artwork, and software belong to us or our licensors. We give you a personal, non-transferable right to use them for your family's learning while your account is in good standing.
- Your learners' work belongs to them. You let us use it only to run the service for you, as our privacy policy describes.
- If you send us ideas or feedback, we may use them without owing you anything.
A service in beta
Semper Math is in beta. We are improving it all the time, so features may change, and some may be added or removed. We do our best to keep it running, but we do not promise it will always be available, uninterrupted, or free of errors. We may pause the service for maintenance or to fix problems.
Ending your account
- You can stop using Semper Math at any time and ask us to delete your account at privacy@sempermath.com.
- We may suspend or close an account that breaks these terms or puts others at risk. If we close your account without a good reason under these terms, we will refund unused purchased time.
- Sections that by their nature should continue (such as payment owed, intellectual property, disclaimers, limitation of liability, and governing law) continue after an account ends.
Disclaimers
Semper Math is an educational aid. We do not guarantee any particular result, grade, or score. To the fullest extent the law allows, Semper Math is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or opportunities, arising from your use of Semper Math.
Our total liability for any claim relating to Semper Math is limited to the amount you paid us in the 12 months before the claim arose. Some places do not allow these limits, so they may not all apply to you.
Indemnity
If someone brings a claim against us because you broke these terms or the law while using Semper Math, you agree to cover our reasonable costs of dealing with it, including reasonable legal fees. This does not apply to claims caused by our own conduct.
Governing law and disputes
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. Any dispute will be heard in the state or federal courts located in Middlesex County, Massachusetts, and you and we agree to that location. Either of us may instead bring a claim in small claims court where it qualifies.
Before filing a claim, please email legal@sempermath.com so we can try to resolve it together.
Changes to these terms
We may update these terms. We will post the new version here with a new effective date, and for material changes we will email account holders before they take effect. If you keep using Semper Math after the changes take effect, the new terms apply. If you do not agree, you can close your account and ask for a refund of unused purchased time.
